Irving health insurance consumers face a federal appeals court concerning the Affordable Care Act. The court says the ACA law in not valid because there is no federal mandate, while supporters of the law strongly disagree.
Irving health insurance recipients are increasingly uncertain about the future of coverage after recent events unfolding in federal courts.
A federal appeals court raised questions with regard to whether or not supporters of The Affordable Care Act (ACA), or commonly known as Obamacare, have standing to appeal a December 2018 federal judge’s December ruling that invalidated all of Obamacare, leaving the law’s future uncertain. Currently, 20 states and the House of Representatives within Congress are appealing the ruling arguing residents would suffer both economically and financially if the ACA is abandoned.
Although providers of health insurance in Irving do not participate directly with Obamacare residents are able to use the federal-run website HealthCare.gov. Consumers can also utilize an independent agent, broker site or company to enroll directly into Obamacare and still receive financial assistance the law provides.
Many healthcare legal experts believe the 5th U.S. Circuit Court of Appeals will rule that states and Congress have standing to continue the appeal process. But regardless of what the ultimate decision is, some believe the ruling will still leave health insurance consumers in an uncertain position. The federal judge’s decision did not issue an injunction blocking ACA enforcement. Consequently, many states could continue to offer Obamacare until an injunction is issued but it’s not clear if this could be successfully done by plaintiffs hoping to eliminate the ACA.
Rick Thornton, an Irving health insurance agent, believes it is a critical period in the future of Obamacare. “Many of my clients are asking questions about how these legal developments will ultimately affect their policies. Will it mean the return of pre-existing condition exemptions? Higher premiums? The sooner many of these questions can be resolved, the better it will be for consumers to make the best decisions for their health,” he states.
